District Court can now hear data protection actions.

On the 9th of January 2024 Minister for Justice Helen McEntee signed the commencement order for section 77 of the Courts and Civil (Miscellaneous Provisions) Act 2023.

From the 11th of January 2024 the District Court can now hear data protection actions under the Data Protection Act 2018 up to the amount of €15,000.

The Data Protection Act 2018 implements the General Data Protection Regulation 2016 into Irish law.

Compliance with GDPR and data protection obligations puts the protection of data privacy “by design and default” and the onus is on organisations to ensure that they are fully in compliance with their data protection obligations.
This involves the training of staff and officers in record keeping, note taking, report writing and as well as the specific obligations a data controller and data processor has under the directive.
